What Is a Health Care Power Of Attorney?

An HCPOA is a document that can let you appoint a trusted individual to make medical decisions on your behalf if you become physically or mentally incapacitated. This document covers critical decisions, including:

  • Treatment options
  • Care settings
  • End-of-life choices
  • Mental health treatment is permitted by state law

An HCPOA can also grant an agent, or the person responsible for carrying out your wishes, access to your medical records. That way, they can effectively communicate your needs and requests to a health care provider.

What Happens With Health Care POAs In The Event Of An Emergency?

If you have a serious medical emergency while incapacitated, medical professionals can provide you with the treatment you need. When critical decisions need to be made about next steps, medical professionals can consult with your health care agent.

What Is A Living Will?

Also known as an advance directive, a living will provides written instructions for your end-of-life care and treatment. It can outline your preferences regarding:

Unlike a living will or HCPOA, a DNR is a specific order and cannot serve as a substitute for these documents.
